These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and Asindie, Inc. ("AsIndie", "PostHubify", "we", "us") governing your access to and use of the PostHubify platform, websites, applications, and API (collectively, the "Service"). By creating an account, connecting an account, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

1. Eligibility & accounts
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. You are responsible for the information you provide, for keeping your credentials secure, and for all activity under your account and API keys. Notify us promptly of any unauthorized use. Accounts are authenticated through our identity provider; you are responsible for safeguarding that login.
2. The Service
PostHubify lets you connect third-party social, messaging, and advertising accounts and publish, schedule, automate, moderate, analyze, and message across them from a dashboard and via an API. We may add, change, or remove features, and we may impose or change limits (such as rate limits, quotas, or spend limits) to protect the Service and comply with platform requirements.
3. Connected platforms & your responsibilities
The Service acts on your behalf with the platforms you connect, using the permissions you grant. You are solely responsible for complying with the terms, policies, and guidelines of every platform you connect, and for having all rights and consents needed for the content and data you process. Platform rules you must follow include (without limitation):
- YouTube Terms of Service and the Google Privacy Policy (Google/YouTube/Google Business/Google Ads);
- Meta Terms and Meta Platform Terms (Facebook, Instagram, WhatsApp, Threads);
- the X Terms and Developer Policy; the TikTok Developer Terms; the LinkedIn User Agreement; the Pinterest Developer Guidelines; and the developer/usage terms of Reddit, Snapchat, Discord, Telegram, LINE, Mastodon (per instance), Bluesky, Tumblr, Spotify, Microsoft, and Dailymotion.
Platforms may change, suspend, rate-limit, or discontinue their APIs at any time; we are not responsible for platform availability, changes, or actions a platform takes against your account. You may disconnect any platform at any time.
4. Acceptable use
You agree not to use the Service to:
- violate any law or any connected platform's rules, or infringe others' intellectual-property, privacy, or publicity rights;
- publish or transmit content that is unlawful, fraudulent, deceptive, hateful, harassing, defamatory, obscene, or otherwise objectionable;
- engage in spam, platform manipulation, coordinated inauthentic behavior, or circumvention of platform or Service rate limits or anti-abuse controls;
- send messages (including SMS) without required consent, or send prohibited or high-risk message categories;
- upload malware, attempt to gain unauthorized access, reverse-engineer, scrape, or overload the Service;
- resell, sublicense, or provide the Service to third parties except as expressly permitted; or
- create, host, or facilitate any child sexual abuse or exploitation material (CSAE) or any content that endangers minors — we maintain zero tolerance, remove such content, and report it to authorities and relevant platforms.
We may investigate suspected violations and may remove content or suspend/terminate access to protect the Service, our users, or third parties.
5. Your content & license
You retain all ownership of the content, media, messages, and data you submit ("Your Content"). To operate the Service, you grant AsIndie a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (e.g., reformat for each platform), transmit, and display Your Content solely to provide, secure, and improve the Service and to publish or deliver it to the platforms and recipients you direct. This license ends when you delete Your Content or close your account, except for content already transmitted to third-party platforms/recipients at your direction, and for residual backups retained for a limited period. You represent that you have all rights and consents necessary for Your Content and its distribution.
6. API & developer terms
We grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access the PostHubify API and SDKs solely to use the Service. You must:
- keep API keys confidential, store them securely (e.g., server-side, not in client code or version control), and rotate compromised keys;
- respect rate limits, quotas, and idempotency requirements, and not attempt to circumvent them;
- not use the API to build a product that replicates or competes with the Service, nor resell raw API access, without our written permission;
- comply with all connected-platform terms when acting through the API.
We may monitor API usage for security, performance, billing, and compliance; and may rate-limit, suspend, or revoke API access or keys for abuse, non-payment, or risk to the Service or any platform. API limits and features may change at our discretion.
7. AI features
AI-assisted features generate suggestions using third-party AI providers (see the Privacy Policy). AI output is probabilistic and may be inaccurate, biased, or unsuitable; you are responsible for reviewing and editing AI output before you publish or send it, for ensuring it complies with law and platform rules, and for disclosing AI use where required. We make no warranty regarding AI output, and we do not use connected-platform data to train AI models.
8. Fees, billing, SMS & wallet
Plans & usage. Some features are free; others are paid, including SMS, one-time-passcodes (OTP), phone numbers, alphanumeric senders, and certain subscription plans/packages. Prices are shown in the Service and may be updated with notice; continued use after a change constitutes acceptance.
Pay-as-you-go & prepaid wallet. SMS and similar usage are charged per message/segment from a prepaid wallet balance. We charge for usage before delivery; if your balance is insufficient and auto-recharge is not enabled (or fails), the action will not proceed. Pricing is set above our carrier/supplier cost and varies by destination country.
Packages & overage. Optional monthly packages include a bundled allowance at a discounted effective rate; usage beyond the allowance ("overage") is charged at the applicable rate.
Auto-recharge. If you enable auto-recharge, you authorize us to charge your saved payment method to top up your wallet when your balance falls below the threshold you set, in the amount you set, on a recurring basis as needed. You can disable auto-recharge at any time.
Subscriptions. Subscription fees are billed in advance and renew automatically until cancelled; cancel before renewal to avoid the next charge.
Payments, taxes & failures. Payments are processed by Stripe; you authorize the applicable charges. Fees are exclusive of taxes, which you are responsible for. Failed or reversed payments may result in suspension. Except where required by law, fees and consumed usage (including SMS already sent and wallet top-ups) are non-refundable. We may offer refunds at our discretion.
9. SMS / telephony compliance
If you use SMS/OTP or phone numbers, you are the sender of record and are responsible for compliance with all applicable messaging laws and carrier requirements (including, in the U.S., A2P 10DLC registration, the TCPA, and CTIA guidelines, and equivalent rules elsewhere). You must obtain and maintain proof of recipient consent, honor opt-out requests promptly, accurately identify yourself, and not send prohibited categories of messages. We may suspend messaging that we reasonably believe is non-compliant, fraudulent, or abusive, and we enforce velocity and daily spend limits.
10. Intellectual property
The Service, including its software, APIs, SDKs, design, and trademarks, is owned by AsIndie and its licensors and is protected by intellectual-property laws. Except for the limited rights expressly granted, we reserve all rights. You may not copy, modify, distribute, or create derivative works of the Service except as permitted by applicable open-source licenses or our written agreement. Feedback you provide may be used by us without restriction or obligation.
11. Third-party services
The Service integrates and interoperates with third-party platforms and services that are governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, or their acts or omissions. Your use of a connected platform is between you and that platform.
12. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that posts will be delivered or published on time; that analytics or AI output will be accurate; or that the Service will be compatible with any platform's current or future requirements.
13. Limitation of liability
To the maximum extent permitted by law, AsIndie and its affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or related to the Service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD 100.
14. Indemnification
You will defend, indemnify, and hold harmless AsIndie and its affiliates, officers, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Your Content or your use of the Service; (b) your violation of these Terms, applicable law, or any connected platform's terms; or (c) your messaging/advertising activities, including SMS recipient claims.
15. Term & termination
These Terms apply while you use the Service. You may stop using the Service and disconnect or delete your account at any time. We may suspend or terminate your access, with or without notice, for any breach of these Terms, non-payment, legal or security risk, or platform requirement. On termination, your license to use the Service ends; we may delete your data after a reasonable period subject to legal-retention requirements (see the Privacy Policy). Sections that by their nature should survive (including ownership, disclaimers, liability limits, indemnification, and governing law) survive termination.
16. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. You and AsIndie submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Service, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
17. Copyright / DMCA
We respect intellectual-property rights and respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA) and comparable laws. If you believe content processed through the Service infringes your copyright, send a notice with the required information (identification of the work and the material, your contact details, a good-faith statement, and a statement under penalty of perjury) to support@posthubify.com. We may remove allegedly infringing content and terminate repeat infringers.
18. Changes to the Service or Terms
We may modify the Service or these Terms. For material changes to the Terms, we will provide reasonable notice (for example, by posting the updated Terms with a new date or by email/in-app notice). Your continued use after the changes take effect constitutes acceptance. If you do not agree, stop using the Service.
19. General
These Terms (with the Privacy Policy and any order or plan you accept, and any Data Processing Addendum for business customers) are the entire agreement between you and AsIndie regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing creates a partnership, agency, or employment relationship beyond the limited agency to act on your behalf with connected platforms as you direct. You consent to receive electronic communications from us.
